RSS feeds: terms and conditions
By downloading an RSS Feed from Scottish Enterprise, you agree to be bound by these terms. We may update these terms from time to time.
Licence
Subject to the terms of this agreement Scottish Enterprise grants you a non-transferrable, non-sublicensable, royalty-free non-exclusive licence to display on your website the headlines, active links or other source identifiers and other information or materials that you specifically select to receive from Scottish Enterprise RSS feeds.
All title, ownership rights and intellectual property rights in and to the RSS feed shall remain the property of Scottish Enterprise.
Nothing in these terms gives you any right to use Scottish Enterprise’s logo on your website or anywhere else.
Use of Scottish Enterprise Content
You may not use the feed or display any Scottish Enterprise content on any website that:
incites hatred whether based on race, religion, gender, sexuality or otherwise, or promote encourage or facilitate anti-social behaviour;
promotes, encourages or facilitates violence, terrorism or other activities that risk UK national security;
discriminates against any specific social group or otherwise exploit vulnerable sections of society;
promotes, encourages or facilitates illegal activity;
is misleading, pornographic, defamatory, or that contains illegal, or otherwise actionable content under UK law; or
infringes individual privacy.
Our RSS feeds and content may only be displayed on websites that do not fall into any one or more of these categories.
Make sure that all Scottish Enterprise content on your site is properly accredited using the phrase ‘News from Scottish Enterprise’ or ‘Events from Scottish Enterprise’ to describe the feed.
You may not charge users for accessing Scottish Enterprise content or feeds, use it for commercial purposes, or re-sell it.
You must create a link to the news, events or other pages that generate the feed. You may not change, edit, add to, alter or produce summaries of Scottish Enterprise content nor place any full story in a frameset.
Use of our RSS feeds does not constitute any approval or endorsement by Scottish Enterprise, and you will not claim any.
You acknowledge that Scottish Enterprise has absolute editorial control over all our content.

Warranties & Liability
You warrant to Scottish Enterprise that:
you have fully complied with, and shall continue to comply fully with, all applicable laws and regulations;
the Site shall contain no material which is libellous, defamatory, pornographic, obscene or which may bring Scottish Enterprise into disrepute, or which is in breach of any third party intellectual property rights; and
users of the Site shall be required to comply with terms that are equivalent to these terms and conditions in relation to their use of Scottish Enterprise content.
We make our RSS feeds available "as is" and "as available" and we give no warranty of any kind in relation to the feed, its content, or any content on our website. Scottish Enterprise disclaims all implied warranties, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, and accuracy.
To the maximum extent permitted by law, Scottish Enterprise excludes all liability to you for any loss or damage howsoever arising out of or in connection with this agreement, including but not limited to any liability arising in relation to the RSS feeds, their content or any content on Scottish Enterprise websites, any virus or other contamination or any unavailability of our content.
Each of these provisions operates separately and survives independently of the others.
Indemnity
You agree to indemnify, hold harmless and defend Scottish Enterprise in respect of all damages, costs and expenses, including reasonable legal fees and litigation expenses, arising out of or as a result of any breach of these terms or otherwise in connection with your use of Scottish Enterprise content.
Termination
You may terminate this Agreement and the licence granted herein at any time by destroying or removing all copies of Scottish Enterprise feeds or content from your website, disk drives, networks and other storage media.
We may restrict, suspend or terminate our feed, this agreement, the licence granted herein or your access to our feed at any time without liability. You agree to destroy all copies of Scottish Enterprise feeds and content upon receiving notice of termination from us.
Clauses 3, 4 and 6 shall survive termination of this Agreement.
General
Neither you nor Scottish Enterprise may assign, charge, sublicense or otherwise deal with their rights or obligations in this Agreement in whole or in part to any third party.
This Agreement supersedes all prior agreements, arrangements and understandings between the parties about use of Scottish Enterprise RSS feeds and content. Each party acknowledges that it has not relied on any statement made by the other in the course of entering into this Agreement.
Any failure or delay by either party in exercising its rights under any provisions of this agreement shall not be construed as a waiver of those rights at any time now or in the future.
This agreement shall be governed by Scots law and the Scottish courts shall have exclusive jurisdiction to settle any claim or dispute which may arise out of or in connection with this agreement.
